Terms of Service for Belka Laser and Fabrication

1. Overview

These Terms of Service govern all projects, quotes, communications, and work performed by Belka Machine Service LLC dba Belka Laser and Fabrication, located at 9210 Cherry Valley Rd Ste A, Caledonia MI 49316. By requesting a quote, submitting files, or authorizing work, you agree to these Terms.

2. Age Requirement

You must be at least 18 years of age to use our services, submit quote requests, place orders, or enter into any agreement with Belka Laser & Fabrication. By using our services, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use our services or submit any information to us.

3. Services Covered

These Terms apply to all services provided by Belka, including: Laser cutting, Press brake forming, Laser welding, Assembly, Finishing, Quote reviews, File checks (tolerances, manufacturability), General fabrication consulting

4. Quotes & Approvals

All quotes issued by Belka are non-binding until approved. A quote becomes approved when Belka receives written or otherwise mutually agreed-upon confirmation, including but not limited to: Email approval, Purchase order submission, Signed documentation, Written confirmation through an online form, Other mutually agreed-upon written methods. Quotes may require adjustments based on file changes, material availability, or clarifications.

5. Payment Terms

Payment terms will be mutually agreed upon before production begins. If no terms are specified, full payment is due prior to delivery or pickup.

6. Lead Times

Lead times provided in quotes are estimates, not guarantees. Timelines may change due to: Material availability, Machine scheduling, Volume changes, Design revisions, Unexpected shop conditions. Belka will communicate changes promptly.

7. Shipping, Delivery, and Pickup

Belka offers: Customer pickup, Belka-arranged delivery, Third-party freight, Carrier shipping (UPS, FedEx, etc.). Shipping costs, risks, and insurance (if any) will be stated during quoting or prior to shipment.

8. Customer Files & Intellectual Property

By uploading or sending any files (CAD, DXF, images, drawings, etc.) you confirm that: You own the rights to the designs, or You have permission to use them. Belka is not responsible for trademarked, copyrighted, or proprietary files submitted by customers. Belka is not liable for manufacturing errors caused by incorrect, incomplete, or defective customer files. Belka stores files in Google Drive and GHL for project management and future reorders unless deletion is requested.

9. Revisions & Rework

Revisions requested after approval may result in: Additional charges, Updated timelines, A new or revised quote. Belka will communicate any required changes before proceeding.

10. Warranty on Workmanship

Belka guarantees that manufactured parts will: Match approved drawings, Meet stated tolerances, Be produced using quality materials. Warranty does not cover damage, misuse, incorrect installation, or design flaws within customer-supplied drawings.

11. Limitation of Liability

To the maximum extent permitted by law: Belka is not liable for lost profits, downtime, production delays, or incidental/indirect damages. Belka's total liability will not exceed the total amount paid for the project in question.

12. Cancellations

Projects canceled after approval may incur fees for: Time already spent, Materials ordered, Work already completed

13. Governing Law

These Terms are governed by the laws of Michigan, specifically Kent County.

14. Data, Privacy & Communication

By submitting a quote or files, you agree to: Transactional communications (emails, calls, SMS), Storage of project information and files, Review of uploaded materials for manufacturability. Marketing communications are optional and require separate consent.

15. SMS Communication Terms

Consent to Receive SMS Messages

By providing your mobile phone number and opting in to receive SMS messages, you consent to receive text messages from Belka Laser & Fabrication at the phone number provided. This may include: Transactional messages about your orders, quotes, and projects, Marketing and promotional messages (if you've opted in). Consent to receive SMS messages is not required as a condition of purchasing any goods or services from Belka Laser & Fabrication.

Opting Out

You can cancel the SMS service at any time by: Texting "STOP" to (616) 867-0064, Replying "STOP" to any text message from us. After you send "STOP," we will send you a confirmation SMS message that you have been unsubscribed. You will no longer receive SMS messages from us. If you want to rejoin, sign up as you did initially and we will start sending SMS messages to you again.
